MOMENTUM BOXING, LLC
RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, AND CONSENT AGREEMENT
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
In consideration of being permitted to participate in any activities, training programs, classes, open gym sessions, events, or use of facilities, equipment, and premises operated by Momentum Boxing, LLC and Hooked Fitness, LLC, I acknowledge and agree as follows:
I voluntarily assume full responsibility for any and all risks of injury, illness, property damage, or death associated with my participation in boxing, martial arts, fitness training, full contact sports, and related activities. I understand that these activities involve inherent risks, including but not limited to physical contact, falls, overexertion, equipment failure, and the actions or inactions of other participants.
I hereby waive, release, covenant not to sue, and forever discharge Momentum Boxing, LLC and Hooked Fitness LLC, its owners, members, officers, employees, contractors, trainers, agents, representatives, volunteers, successors, assigns, and the owner(s), landlord(s), property manager(s), and lessor(s) of the premises, including any affiliated entities, from any and all claims, demands, causes of action, damages, liabilities, costs, or expenses, whether known or unknown, arising out of or related to my participation or use of the facilities.
This release includes claims arising from the negligence, passive or active, of any of the released parties, to the fullest extent permitted by law.
USE OF PREMISES AND LANDLORD DISCLAIMER
I acknowledge that Momentum Boxing, LLC and Hooked Fitness LLC does not own the premises and that the landlord, property owner, and property management entities do not supervise, control, or participate in gym activities. I agree that the landlord bears no responsibility or liability for injuries, damages, or losses occurring as a result of my participation in activities conducted by Momentum Boxing, LLC and Hooked Fitness LLC.
INDEMNIFICATION
I agree to indemnify, defend, and hold harmless Momentum Boxing, LLC and Hooked Fitness LLC and all released parties, including the landlord and property owner, from any claims, actions, damages, costs, or attorney fees arising from my participation, conduct, or breach of this agreement, including claims brought by third parties or on behalf of a minor.
MEDICAL REPRESENTATION
I affirm that I am physically and mentally capable of participating in strenuous physical activity. I have consulted a physician or voluntarily chosen not to do so and accept full responsibility for my health condition. I am not under the influence of alcohol, drugs, or any substances that would impair my ability to safely participate.
I understand that Momentum Boxing, LLC and Hooked Fitness LLC does not provide medical advice or supervision and that I am solely responsible for determining my fitness to participate. I have been advised to confirm that my insurance coverage applies to these activities.
CONSENT TO USE IMAGE AND LIKENESS
I grant Momentum Boxing, LLC and Hooked Fitness LLC the irrevocable right to use photographs, video recordings, and other media of me for promotional, marketing, educational, and advertising purposes across all platforms, including websites and social media, without compensation or further approval. I waive any right to inspect or approve the finished content.
MINORS
If the participant is under the age of 18, I represent that I am the parent or legal guardian of the minor and have the legal authority to execute this agreement on their behalf. I agree that all terms apply equally to the minor participant and that I assume full responsibility for the minor’s participation.
ACKNOWLEDGMENT AND AGREEMENT
I acknowledge that I have read this agreement carefully, understand its contents, and voluntarily agree to all terms. I understand that by agreeing, I am giving up certain legal rights, including the right to sue. This agreement shall be binding upon myself, my heirs, assigns, and personal representatives.
By submitting this form or agreeing at the time of payment, I confirm my acceptance of this Release of Liability, Assumption of Risk, Indemnification Agreement, and Consent to Use Image.
